A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

피고인은 2018. 6. 23 01:00 경 서울 서초구 소 재 뱅뱅 사거리에서 술에 취해 피해자 C(61 세) 가 운전하는 D 택시에 승차 하여 목적지인 서울 마포구 연 남로 소재 코오롱 하늘 채 아파트로 가 던 중, 같은 날 02:00 경 서울 서초구 반포대로 222 소재 강남 성모병원 근처 도로에서 피해자가 정지 신호에 따라 차량을 정차하기 위해 서 행하자 갑자기 아무런 이유 없이 손으로 피해자의 얼굴을 수회 때리고, 이에 피해자가 112에 신고하기 위해 강남 성모병원 근처 도로에 위 택시를 정 차한 후 운전석에서 휴대전화로 112 신고를 하자, 운전석 바로 뒷좌석으로 자리를 옮긴 후 계속하여 양손으로 피해자의 목을 잡아 피해자의 얼굴을 뒤로 세게 젖혀 꺾이게 하고, 손으로 피해자의 얼굴을 수회 때려 피해자에게 약 14일 간의 치료가 필요한 얼굴 부분의 표재성 손상 등을 입게 하였다.

Accordingly, the defendant assaulted the victim who is a driver of a vehicle in operation and caused the injury.
