The appeal is dismissed.
Reasons
1. The summary of the grounds for appeal (e.g., e., 10 months of imprisonment without prison labor and 2 years of suspended execution) is too unreasonable.
2. The judgment of the defendant is against his mistake, and there is no criminal history other than once of fine, the defendant's agreement with his bereaved family members, the defendant's vehicle is covered by a comprehensive insurance policy, the victim's negligence appears to have been committed without sufficiently examining the pre-entry, pre-entry, and right and right of the victim's fault, and the victim's negligence appears to have been caused by the accident, such as the 44th page of the evidence record.
However, the crime of this case results in the death of a victim who was under 17 years of age by temporarily stopping prior to entering the intersection and causing a traffic accident due to negligence in progress without examining the right and the right, and according to the attached Table 2 of the Enforcement Rule of the Road Traffic Act, the purport of the Defendant’s negligence that “motor vehicles and horses may proceed with with the warning of marking on and off of a yellow light to other traffic or safety signs” and “motor vehicles and horses may proceed with with the warning of marking on and off of a red light” is stated as follows: “When there is a stop line or crosswalk, vehicles and horses may temporarily stop immediately before or after leaving the intersection, and continue with due care for other traffic.”
The intersection where the accident in this case occurred is a place where red flickering lights etc. are in operation in the direction of driving the car of the defendant, and yellow flickering lights etc. are in operation in the direction of driving the victim's ozone, and in such a case, the defendant is obliged to temporarily stop to enter the intersection and yield the course to the victim who is proceeding with yellow flickering lights, etc.
In light of the result of the crime, the responsibility for the crime is grave, and the parent of the victim seems to have suffered a big mental suffering due to the death of the child, and the defendant is trying to be punished corresponding to the responsibility.
