A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On July 18, 2018, the Defendant sent a text message to the victim B (the 13 years of age), who was known prior to the towing, to the Messenger, to the effect that the Defendant did not sufficiently form sexual values and judgment abilities, thereby exercising sexual self-determination rights or protecting himself/herself due to the lack of sexual values and judgment capabilities, and from that time sent a text message to the effect that the Defendant was “Asiba, Ilba, Ild, Ild, Ild, Ild, Ild,” from that time.

7. 27.경까지 사이에 불상지에서 C 메신저로 피해자에게 ‘ 얼마나 컸는지 궁금하고, 상상이 안돼’, ‘보고 싶어 미치기 일보직전이야’, ‘안마기 진동으로 하면, 안마기 있어 하고 있나 보고 싶다’는 취지의 문자메시지를 전송하고, 계속해서 떡볶이, 주스, 화장품, 치킨 등의 상품권을 보내주면서 ‘진짜 보고 싶어 얼마나 예뻐지고 컸는지, 영상주면 내일 줄 수 있어’라는 취지의 문자메시지를 전송하여 피해자로 하여금 자위하는 장면을 촬영한 동영상을 피고인에게 전송하게 하고, 계속해서 ‘자위 신음소리 듣고 싶어, 가슴도 보고 싶고’, ‘그럼 벌려만 줘’, ‘가슴이랑 보지 벌린거랑 얼굴 보고 싶었는데’라는 문자메시지를 전송하고, 피해자에게 눈꽃빙수 상품권을 보내주고 ‘여자는 아래를 잘 씻어야한데’, ‘아흥 싸버렸어’라는 취지의 문자메시지를 전송하였다.

As a result, the Defendant committed sexual abuse such as sexual harassment that causes a sense of sexual humiliation to children.
