그럼에도 C는 2015. 3. 초순경부터 2015. 3. 24. 경까지, 피고인은 2015. 3. 22. 경부터 2015. 3. 24. 경까지, 위 게임 장에서 나폴리 20대, 고인돌 포커 30대, 삼국 명장 20대, 하제 포커 30대 등 게임기 합계 100대를 설치하고 자동 누름장치( 일명 똑딱이 )를 이용하여 실력이 아닌 운에 따라 자동으로 게임이 진행되도록 한 후 불특정 다수의 손님들이 위와 같이 운에 따라 획득한 게임 점수를 카드에 입력하고, 불특정 다수의 손님들은 F 등 다른 손님들과 위 카드를 이용하여 카드인식 기를 통해 확인된 금원의 10%를 공제한 현금과 교환하게 하였고, 위 카드를 소지하고 있는 손님들에게는 누구나 그 점수 만큼 게임기에 입력해 주어 손님들이 위 게임기를 다시 이용할 수 있게 하였다.
