A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 31, 2016, the Defendant: (a) within the “D party room” located on the 32th floor of Ansan-si, Masan-si; (b) “The victim E has tobacco purchased at a water mutual aid association for the purpose of insurance processing and wrapping if any traffic accident occurs while transporting tobacco at the water mutual aid association; and (c) the acquisition and sale of the tobacco can obtain a significant benefit per week.

Since there is no cash by investing the money in another place, it will be repaid one week after lending the money.

“A false statement” was made.

However, the Defendant did not have any relation with the cargo mutual aid association at the time, and even if he borrowed money from the injured party, he did not have the intention or ability to purchase the tobacco handled by the cargo mutual aid association.

In other words, the Defendant received 13 million won from the injured party for the purchase price of tobacco at the seat, and acquired 41.3 million won through a total of six times, such as the list of annexed crimes, by transfer from the Defendant to the new cooperation account (F) in the name of the Defendant.

Accordingly, the defendant was given property by deceiving the victim.

"2017 Highest 1096"

1. On April 16, 2017, the Defendant: (a) around 00:31, in front of the I restaurant operated by the victim H of the victim H in the 1st floor of Ansan-si, Seoul Special Metropolitan City, Ansan-si; (b) opened a treasury with a road located in the main room; (c) opened a bank with a road that was located in the main room; (d) caused the victim’s cash amounting to KRW 5,00,000, the CCTV parts equivalent to the market value of KRW 200,000,000, the market value of which was stolen.

2. On April 16, 2017, the Defendant: (a) around 00:50, the victim K, which was on the top of the G1st floor of Ansan-si, Seosan-si, J1, destroyed and damaged the reading center of the main entrance, which was corrected by hand, and entered into the entrance, and opened a stolen-friendly treasury, as described in paragraph 1; (b) took cash 120,000 won owned by the victim and CCTV parts in the market price.
