1. The Defendant’s KRW 40,516,164 and KRW 40,00,00 among the Plaintiff’s KRW 40,516 and KRW 12,00 per annum from November 7, 2018 to December 8, 2018.

Comprehensively taking account of the written evidence Nos. 1 and 2 and the purport of the entire pleadings, it is recognized that the Plaintiff extended a loan of KRW 40 million to the Defendant on September 8, 2017, with a maturity of KRW 3.08% per annum on mutual interest rate and KRW 8.5% per annum, and delayed damages with a maturity of KRW 40 million, if the contractual interest rate is less than one month from the date on which the overdue period falls short of one month from the date on which the overdue period falls short of one month from the date on which the overdue period falls short of one month, 9.5% per annum, and more than three months, respectively.

According to the above facts, the Defendant is obligated to pay the Plaintiff the interest at KRW 40,516,16,164 (the agreed interest at the rate of 5% per annum from September 6, 2018 to September 10, 2018; interest at the rate of 8% per annum from September 6, 2018 to November 6, 2018; interest at the rate of 12.58% per annum from November 7, 2018 to December 8, 2018; interest at the rate of 5% per annum from September 5, 2018 to September 10, 2018; interest at the rate of 8% per annum from September 6, 2018 to November 6, 2018; interest at the rate of 12.58% per annum from October 3, 2018 to December 5, 2018; and interest at the rate of 3.5% per annum from March 18, 2018.

The plaintiff's claim is reasonable, and it is so decided as per Disposition by the assent of all participating Justices.
