A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From December 2, 2014 to February 3, 2017, the Defendant was a person who worked as the head of the branch office of the three North Korea branch in the East Sea from March 2, 2014 to February 3, 2017, and the victim D (n, 23 years of age) was working as a contractual employee of the said branch from August 24, 2015 to February 2017. The victim, who is a contractual employee within the company, shall enter into a new employment contract every year for about two years after entering the company, and the service performance for the preceding one year after being evaluated as the service performance during the course of a new contract, may continue to work at the said branch. The Defendant, the head of the branch office, shall direct and supervise the overall work of the victim, evaluate the victim’s work performance, and exercise significant influence in determining whether to conclude a new employment contract with the victim.

The defendant committed an indecent act by force against the victim under the protection or supervision of the defendant due to business affairs, employment or other relationship three times as follows, by taking advantage of the victim's location where the defendant's demand is difficult, or where the defendant refuses or fails to comply with misconduct in determining whether the victim's employment contract should be re-concepted.

2. From August 2015 to April 2016, the Defendant commits an indecent act during the period from August 2015 to around April 2016, 2016, following the victim’s knee and knife at the counseling room at the same point, and knife the victim’s knife with his knife.
