A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

At around 22:30 on May 26, 2014, the Defendant: (a) reported that the Defendant’s spouse F was wn up with E and money in front of “D” in Jeju Island; and (b) reported that the Defendant’s spouse F is wn at the police’s place.

위와 같은 신고를 받고 출동한 제주서부경찰서 G파출소 소속 경찰관 경사 H과 순경 I이 위 일시장소에서 F로부터 신고경위를 청취하고 남자들이 싸우고 있다는 장소로 이동하려하자, 피고인의 동네선배인 J(공동피고인)은 갑자기 경찰관들이 세워둔 순찰차량을 걷어차고 “왜 그냥 가냐 씹새끼들아”라고 욕설을 하면서 H에게 주먹을 휘두르고 멱살을 잡아 밀고 당기기를 반복하여 H의 외근조끼가 벗겨지게 한 다음 그를 바닥에 넘어뜨리고, 이를 제지하기 위해 I이 테이저 건(전기충격기)을 꺼내자 “쏴봐 새끼야”라고 욕설을 하면서 손으로 I의 손목을 쳐 테이저 건을 바닥에 떨어지게 한 다음 주먹으로 그의 얼굴과 목 부분을 수회 때리고 발로 정강이 부분을 걷어차 폭행하였다.
