1. The Defendant (Counterclaim Plaintiff) on April 1, 1984 with respect to each of 1/7 shares of the Plaintiff (Counterclaim Defendant) in the area of 547 square meters prior to I in Sungsung-si.

1. Evidence 【Evidence】1-1, 2, A2-1 through 3, 1-1 through 5, 2-1 through 4, 3-1 through 3, 3-1, 4-1, 2, and the purport of the whole pleadings;

A. On the ground of the sale on February 5, 1948 with respect to the area of 1593 square meters before J in Sung-si, Suwon District Court, the registration of ownership transfer was completed as the receipt No. 4849 on July 23, 1959 with respect to the area of 1593 square meters in Suwon-si.

On December 23, 1980, the said land was divided into 1046 square meters and 547 square meters prior to IJ (hereinafter “instant land”). On October 15, 1970, L’s exercise of the right of subrogation of the right of claim for transfer of ownership on the ground of sale and purchase, the registration was completed on August 31, 1981 with the said J 1046 square meters and 547 square meters prior to IJ (hereinafter “instant land”).

Then, on August 31, 1981, due to the sale on November 20, 1973, the registration of ownership transfer was completed in the name of L according to the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094). The instant land remains in the name of K without being divided.

B. L is the owner of K and completed the registration of transfer of ownership in its name in accordance with Act No. 3094 of July 4, 1981 on the ground of sale on February 15, 1960 with respect to the 1422 square meters of the above M, which is the owner of K.

In addition, as indicated in the attached text, the above JJ's previous conviction and M are adjacent to each other, and the land of this case is adjacent to the above J.

C. Meanwhile, on April 7, 1964, the Plaintiff purchased 331 square meters from N in Sung-si, O, and completed the registration of ownership transfer with respect to the above land (hereinafter “instant land”) on April 21, 1964.

L has completed the registration of ownership transfer on October 23, 1993 with respect to the land in the Plaintiff’s name due to sale on October 15, 1970.

On the other hand, the instant land remains in the name of K after being divided and remains in the name of Suwon District Court pursuant to Act No. 3094, Jul. 10, 1987, the registration of preservation of ownership in the Plaintiff’s name was completed by the receipt of the 3440 on July 10, 19

E. K died on August 11, 1994, and the spouse, children B, C, D, E, F, G and Q as property inheritor. Q is the spouse, children C, D, E, F, and Q on October 28, 1998.
