피고인은 2019. 3. 28. 01:13경 울산 남구 B에 있는 'C' 가게에서, 옆 자리의 손님들과 다투던 중 112신고를 받고 현장에 출동한 울산남부경찰서 D지구대 소속 경장 E으로부터 제지당하자 화가 나, E에게 ‘씹할 놈아, 미친 놈아, 개새끼야. 왜 상대방 편만 드느냐!’라고 욕설을 하면서 손으로 E이 입고 있던 옷을 잡아당기고, 발로 E의 정강이 부위를 찼다.
