Criminal facts

The Defendant was elected as the candidate for E party in the election district for the 20th National Assembly member that was implemented on April 13, 2016, and F was a person who supported the online election campaign of the candidate affiliated with E in the above election.

No person shall provide money, valuables, or other benefits in connection with an election campaign, regardless of the pretext thereof, such as allowances, actual expenses, or compensation for volunteers, except for the cases where allowances, actual expenses, or other benefits are provided under the Election of Public Officials Act.

Nevertheless, on March 29, 2016, the Defendant requested F to prepare an election campaign bulletin containing the Defendant’s campaign promises, election tax activities, etc. and post it on the Defendant’s page, etc., and requested F to actively engage in the online election campaign during the election campaign period, when remitting KRW 2 million to F’s account on March 30, 2016.

After that, from March 31, 2016 to April 12, 2016, F made an online election campaign against the Defendant by preparing an election campaign bulletin containing the campaign pledges and election campaign promises and details of election tax activities of Defendant, such as “G, H, I, “J,” “K,” “K,” “L,” “M,” “N,” “O,” “P, Q, “R,” “S,” “T,” and “T,” and posting the information unfavorable to the Defendant’s candidate.

Accordingly, the defendant provided F with money and valuables other than money and valuables permitted by the Public Official Election Act in relation to election campaign.
