1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. D Co., Ltd. (hereinafter “D”) was the implementer and seller of the F Commercial Building (hereinafter “instant commercial building”) with the third underground and the sixth above ground located in Nam-gu Incheon Metropolitan City E, and registered the preservation of ownership of the instant commercial building on February 22, 2010, and trusted the instant commercial building to G Co., Ltd. on June 25, 2010.
B. The Plaintiff, a corporation established on August 5, 2013, for the management of the building, etc. of the instant commercial building, concluded a building management entrustment agreement for the management of the instant commercial building (hereinafter “instant management agreement”) with H and I representativeJ as of August 12, 2013, and performed duties, such as the imposition and collection of management fees, from September 1, 2013, when managing the instant commercial building until June 23, 2014, when the management body of the instant commercial building began to manage the commercial building of this case.
C. On August 13, 2013, Defendant B Co., Ltd. (hereinafter “Defendant B”) completed the registration of ownership transfer on the grounds of the sale on May 27, 2013 with respect to 53 stores (K through L, M through N,O through P, Q, R through S, T, U through X, W through X, Y, Zho, AAho, AB through AC, AD through AE, AF through AE, AH through AE, AH, and hereinafter “instant store”), and among them, the registration of ownership transfer was completed on the grounds of the sale on May 27, 2013 with respect to the remaining 49 stores other than K through AI, AH, and on the trust of Defendant CJ on December 27, 2013, Defendant C acquired the ownership of the instant store on December 14, 2014.
On November 2, 2013, AK held a management body meeting of the instant commercial building and elected as the president of the management committee of the instant commercial building. After concluding a management contract with respect to the designation of AL corporation as the controlled entity of the instant commercial building and the entrustment of management, the management committee of the instant commercial building and AL corporation shall be the Incheon District Court against the Plaintiff, etc.
