Reasons
Punishment of the crime
1. Defendant B
(a) No person, other than the Korea Sports Promotion Foundation and the Seoul Olympic Sports Promotion Foundation and the entrusted business entity, shall issue sports promotion betting tickets or similar things (including the issuance by means of information and communications networks) and provide property or property benefits (hereinafter referred to as "similar act") to persons who win at the betting results;
Nevertheless, from October 2, 2014 to January 6, 2015, Defendant B opened and opened an illegal Internet sports soil site (hereinafter “H”, I, etc.) on which the server was placed in Japan, and deposited KRW 819,071,00 in the J’s account (K), etc. from the members of the above site, deposited KRW 819,071,00, and charged the members with the betting money before the sports game, such as a axis, etc., and operated it by means of paying a certain percentage of dividend to the members who loaded the betting book, and recovering it from the members who did not pay a certain percentage of dividend in accordance with the actual result of the sport.
Thus, even if the defendant is not a trustee of the Korea Sports Promotion Corporation, he did not issue sports betting tickets or similar things and provided property or property benefits to a person who correctly predicted the result, and at the same time opened a place or space which is stuffed for profit.
B. Defendant B violated the Electronic Financial Transactions Act in order to use the said Internet illegal sports soil site for entry in betting money, dividends, etc. in a park near Suwon-gu Gtel around October 1, 2014. In addition, Defendant B received a passbook and a e-mail card, security card, and password from the J in its name from the bank account (Account Number K) and received the same opportunity, such as the passbook and the e-mail card with the total number of three accounts as indicated in attached Table 1.
