Punishment of the crime

On May 6, 2008, a civil society organization with 1,500 U.S. beef co-operation, etc. organized a "National Countermeasure Council (hereinafter referred to as the "Countermeasures Council") with a view to organizing a strike against full import of U.S. beef in the U.S., on the grounds that "the phase-out expansion agreement of U.S. beef import concluded with the Government of the Republic of Korea on April 18, 2008 is about to cause harm to the people's health, as well as the stroke negotiation."

Since May 2, 2008, the countermeasures conference followed the candlelight assembly against the import of U.S. beef, which was held in the Cheongyang-dong Seoul Jongno-gu, Jongno-gu, Seoul, following the candlelight assembly from May 6, 2008. On May 24, 2008, the candlelight assembly was held every day at the candlelight square. From May 24, 2008, the countermeasures conference tried to enter the Cheongdae-gu road, such as Sejong-ro, paper, newspaper, etc. after the candlelight assembly was convened every day from the Cheong River square or Seoul square to the day following the day of the candlelightlight assembly.

On May 27, 2008, from around 19:05 to 21:15, the countermeasures conference proceeded with a candlelight assembly through free speech, relief, singing performances, etc. in the presence of 1,500 participants, including members of the countermeasures conference.

After that, from May 27, 2008 to 02:00 of the same month from May 28, 2008, the above 1,50 persons were engaged in a demonstration with the whole lanes around the front of the Seoul Metropolitan Government Office.

On May 27, 2008, the defendant also participated in the candlelight assembly held in the candlelight square around 21:00 on May 27, 2008. Then, around 00:25 on May 28, 2008, the defendant conducted a demonstration, such as moving the front line of the police station in front of the Seoul Central Government Office, until he is arrested as a flagrant offender at the police station in front of the Seoul Central Government Office.
