Reasons
1. Basic facts
A. The land in Gyeong-gun, Gyeong-gun was divided into F with the land of 856 square meters (hereinafter “the land in this case”) before F, the land in this case No. 2 and the land in the G with the land of 499 square meters before G (hereinafter “the third land”).
B. On October 20, 1969, Defendant C changed the registration of transfer due to sale on October 15, 1969 with respect to the land of this case, and H changed the registration of transfer due to sale on March 10, 1981 with respect to the land of this case No. 2 on March 10, 1981 from May 5, 1970 to J (H’s assistance). H completed the registration of transfer pursuant to the former Act on Special Measures for the Registration, etc. of Transfer of Real Estate Ownership (Act No. 3094, Dec. 31, 197);
The plaintiff completed the registration of transfer of ownership on October 20, 1969 with respect to the land of this case No. 3 on May 1, 1969, respectively.
C. H installed a tombstone on the lower part of the instant land; the Defendants, who are siblingsed, installed a tombstone on the upper part of the instant land No. 2; and the Plaintiff installed a tombstone on the middle part of the instant land No. 2; and the parent and the mother’s funeral (including a tombstone) on the middle part of the instant land.
After that, pursuant to the former Act on Special Measures for the Registration, etc. of Ownership Transfer (Act No. 7500 of May 26, 2005, hereinafter “Special Measures Act”), H completed the registration of ownership transfer for the land of this case on July 13, 2006, due to sale on February 20, 1979, and Defendant C completed the registration of ownership transfer for the land of this case on July 27, 2006, respectively.
E. On October 30, 2017, Defendant C completed the registration of ownership transfer on the land of this case to Defendant B on September 20, 2017.
