Reasons
Punishment of the crime
[Criminal record] On September 21, 2017, the Defendant was sentenced to six months of imprisonment for fraud in the Busan District Court’s Vice-Support, and completed the execution of the sentence on January 20, 2018.
[2] On August 2, 2018, around 03:00 on August 2, 2018, the Defendant: (a) committed as if the Defendant were unable to pay the alcohol value at the “D” head office of the Victim C operated in Gwanak-gu in Seoul Special Metropolitan City, even though he did not have any intent or ability to pay the alcohol value; and (b) ordered one, 500cc 3 residues, and Kafri Co., Ltd. to do so; and (c) the Defendant was provided with alcohol and alcohol equivalent to KRW 22,00 in total the market value from the damaged person.

1. On July 13, 2017, the Defendant: (a) around 19:30 on July 13, 2018, the Defendant ordered “G” restaurant for the victim F operation in Dongdaemun-gu Seoul Dongdaemun-gu, to pay the food value, as if he/she did not have an ability or intent to pay the food value; and (b) the Defendant was provided with alcoholic beverages and foodstuffs equivalent to KRW 24,00 in total at the market price from the damaged person.
2. On July 27, 2018, the Defendant: (a) around July 27, 2018, at the “JJ” House of the Victim I Operation in Dongdaemun-gu Seoul, Dongdaemun-gu, (b) issued an order of Maerju 22 C and Madern Ha, etc. to pay the alcohol value despite the absence of the ability or intent to pay the alcohol value; and (c) the Defendant was provided with alcohol and alcohol equivalent to a total of KRW 100,000 from the damaged person’s market price.
[2018 Highest 5728] around 11:30 on July 17, 2018, the Defendant was engaged in driving as if he did not have any intent or ability to pay the drinking value in the “M” operation of the damageer L in Jung-gu Seoul, Jung-gu, Seoul, and ordered 4 Puler, 1, 1, 1, 2, and 2, 32,000 won in total from the damageer.
[2018 Highest 7107] The Defendant paid the completion in spite of the absence of his/her intent or ability to pay the drinking value at the ‘PP’ restaurant operated by the victim located in Gangdong-gu Seoul Metropolitan Government N around July 20, 2018.
