Defendants shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. A person who intends to engage in credit business in violation of the Registration of Credit Business, etc. and Protection of Financial Users Act shall register with the Mayor/Do Governor having jurisdiction over the place of business, and if unregistered credit service providers make a loan, he/she may not charge interest exceeding 30% per annum, which is the highest interest rate under the Interest Limitation Act;
The Defendants: (a) as a loan solicitor of E, the Defendant, along with F, had a person who is not able to obtain a loan in the first financing zone due to a low credit rating due to a loan of the second financing zone; (b) had the person who is able to obtain a loan in the second financing zone repay the obligations of the second financing zone; and (c) had the person who is able to obtain a loan in the second financing zone increased due to the repayment of the second financing zone loan; and (d) had the person who is able to obtain a loan in the first financing zone to engage in the credit business in the manner of a prompt-to-face loan, i.e., a repayment of the first financing zone loan; and (e) had the person who received a loan in the first financing zone
The Defendants, in collusion with F on February 14, 2012, lent approximately KRW 49,400,000, including principal and interest, to H at the office of lock-gu Seoul Metropolitan Government Office located on the third floor of GG Building without registration of credit business (48%) and thereafter, borrowed approximately KRW 47,50,000, including principal and interest (48% per annum), and actually received approximately KRW 49,400,000 after one month after the above date.
4. From the 17th day to the day, a person engaged in unregistered credit business over a total of 56 times (56 applicants) such as the table of “attached Form” and received interest exceeding 30% per annum, which is the highest interest rate under the Interest Limitation Act.
2. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (information and communications network infringement, etc.) shall be knowingly provided with such personal information for profit or unjust purposes
