A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

피고인은 2016. 9. 17. 14:30경 경기 광주시 C에 있는 ‘D’ 건물에서 지인들과 함께 화투를 치던 중 자신이 같은 모양의 화투 3장이 겹쳐 속칭 ‘뻑’한 것을 보고 옆에 있던 피해자 E(68세)이 “자뻑 같은데..”라고 말하자 화가 나 피해자의 멱살을 3-4회 잡아 흔들어 피해자에게 약 3주간의 치료가 필요한 척수병증을 동반한 경추간판장애 등의 상해를 가하였다.
