1. Revocation of a judgment of the first instance;
2. The plaintiff's claim is dismissed.
3. All costs of the lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On March 8, 2010, the Plaintiff concluded an insurance contract with the Defendant as the insured and entered into an insurance contract with the same content as the attached list (hereinafter “instant insurance contract”).
B. The Defendant asserted that the Defendant was hospitalized 16 times after the conclusion of the instant insurance contract as indicated in the following table of payment of the insurance proceeds, and that the Plaintiff’s total amount of KRW 10,860,000 is KRW 11,40,000 for the amount of the insurance proceeds received by the Defendant, but the amount recognized as evidence is only KRW 10,860,000.
Meanwhile, the Plaintiff sought only KRW 10,140,000 as the claim of this case.
B was paid as insurance money.
