The sentence of sentence against the defendant shall be suspended.

Punishment of the crime

D Co., Ltd. is a corporation established on December 22, 1966, which had its head office in Daegu-gu E and runs 8 business with 25 full-time workers in manufacturing or selling oxygen, nitrogen, gas, etc., and the Defendant is a corporation’s actual representative, who actually manages matters concerning safety and health of workers belonging to the place of business, and is engaged in acts for D.

1. A business owner shall take measures necessary for the prevention of hazards caused by explosives, ignitable or inflammable substances in operating his/her business, and prepare and manage a plan for the classification of places where inflammable or inflammable substances are manufactured, handled or used as part of the plan in the place where they are inflammable or inflammable as part of the plan;

Nevertheless, on November 9, 2016, the Defendant did not prepare and manage an explosive level in a facility for manufacturing ethylene, which is a place for manufacturing, handling, or using inflammable gas at the time of supervising the place of business.

2. A business owner shall take measures necessary for the prevention of dangers caused by explosive, inflammable or inflammable substances in operating his/her business, and as part of the measures, shall ensure that there is no danger of transition in cases where he/she handles containers, such as melting metal or gas, etc. used for heating;

Nevertheless, on November 9, 2016, the Defendant did not take measures to prevent electricity in handling gas containers, such as oxygen, nitrogen, carbon dioxide, heel, ethylene, and hydrogen, even though there is a danger of her prior to the supervision of the workplace.

3. A business owner shall take measures necessary to prevent the danger in a place where a worker in his/her work is likely to fall, and as part of his/her work, take protective measures, such as safety rail, fence, vertical fall telescope, or cover, in a place where a worker is likely to fall by the end or opening of his/her work board and passage;
