1. As North Korean defectors, the Defendant: (a) purchased and sold vehicles in the name of the loan requester in the manner of “vehicle tin” and requested loan work by providing necessary documents, such as a certificate of personal seal impression; (b) purchased vehicles in the name of the Defendant or H and disposed of them in the name of the Defendant, with an automobile premium loan, etc. and made a plan to leave the country abroad, and thus, there was no intention or ability to pay the loan normally; and (c) there was no intention or ability to operate the vehicle.
I The Defendant related to the vehicle, along with F, G, etc., purchased the vehicle by I and I in accordance with the foregoing public invitation, at the Hyundai MotorJ agency located in Seo-gu Incheon, Incheon around October 17, 2013, and submitted a false benefit passbook, etc. with respect to the Defendant to the victim Hyundai Capital Co., Ltd., and purchased the vehicle from the damaged company with an installment loan of KRW 30,000,000 in the name of the Defendant and sold the vehicle to the name of the victim, and then sold it to the name of the victim.
Accordingly, the Defendant, in collusion with F and G, by deceiving the damaged company as above, and by allowing the victimized company to pay the purchase price for a passenger car, thereby acquiring pecuniary benefits of KRW 30,000,000.
B. Paragraph 1(b) of this Article is applicable to the Defendant related to KK Cormodo Investment Vehicle.
With the knowledge of the fact that it is possible to prepare cash in the manner of "motor vehicle tin" as described in the paragraph, the North Korean defectors introduced the F, etc. as a loan broker to H, and attempted to purchase and sell the vehicle in H name through G, etc. to prepare cash, etc.
