Defendant shall be punished by a fine of five million won.
If the defendant does not pay the above fine, the amount of KRW 100,000 shall be paid.
Reasons
Punishment of the crime
1. On August 12, 2014, the Defendant violated the Electronic Financial Transactions Act (hereinafter “Electronic Financial Transactions Act”) transferred the access media to the above name-free individuals through Kwikset’s service, stating that “The Defendant would give three million won per month” in front of the Defendant’s house located in the Hanam-si B, and then consented to the proposal of the name-free box, and then transferred the access media, such as the passbook (C) and the physical card connected thereto, security card, etc., which was opened in the name of the Defendant.
2. On August 14, 2014, the Defendant embezzled 4 million won out of the total amount of 5 million won at a non-permanent sports entertainment site through E, when the victim D knew of the fact that he/she misrepresented the borrower at around 19:21, and deposited KRW 5 million in the corporate bank account transferred as described in the foregoing paragraph 1 through a mobile phone notification service. On the same day, the Defendant embezzled 4 million out of the total amount of 5 million at a non-permanent sports site at around 19:26-19:31 on the same day.
3. Although the Seoul Sports Promotion Foundation and a person, other than an entrusted business entity, who violated the National Sports Promotion Act, issued sports promotion voting rights or things similar thereto (including the publication through an information and communications network) and issued goods or property benefits (hereinafter “similar act”) to a person who correctly predicted the result, the Defendant deposited KRW 4 million with the foreign exchange bank account designated at the above site as described in the above paragraph 2, and deposited KRW 4 million into the foreign exchange bank account designated on August 14, 2014, the Defendant deposited the game money in total from August 22, 2013 to August 14, 2014.
