1. On September 4, 2014, the National Labor Relations Commission rendered relief for unfair dismissal between the Plaintiff and the Intervenor.
Reasons
The Intervenor joining the Defendant (hereinafter referred to as the “ Intervenor”) is the representative of C (hereinafter referred to as the “instant workplace”) who engages in the business of collecting and transporting household wastes by employing nine full-time workers. On April 1, 2009, the Plaintiff entered the instant workplace and worked as a driver of the vehicle collecting industrial wastes and a U.S. employee of the vehicle collecting food waste.
On January 15, 2014, the instant disciplinary intervenor dismissed the Plaintiff as of February 17, 2014, following the resolution of the disciplinary committee (hereinafter “Disciplinary Reason Nos. 1 through 4”).

1. Occurrence of a vehicle safety accident;
A. On December 31, 2012, at around 15:30 on December 31, 2012, an insurance company is required to pay KRW 2.80,000 as the compensation for the large property, when the crime was brought back by D E and the accident occurred.
B. On March 12, 2013, around 03:46, there was an accident where the company’s vehicle insurance premium increased by KRW 320,000 and KRW 1.5 million was paid by the insurance company as a substitute property compensation.
2. Not collecting food waste and inferior conditions of collection;
(a) Failure to remove food waste on October 28, 2013;
(b) Not collecting food waste on November 12, 2013;
3. Violation of business instructions;
(a) Absence without permission of the agency on October 28, 2013 on the date of the on-site evaluation of the agency conducted in Chuncheon;
(b) On December 28, 2013, 201;
4. On March 2, 2014, the Plaintiff asserted that the instant disciplinary action was unfair dismissal and filed an application for unfair dismissal with the Gangwon Regional Labor Relations Commission, but the Gangwon Regional Labor Relations Commission dismissed the Plaintiff’s application on May 14, 2014.
The plaintiff of the review decision by the National Labor Relations Commission is in the above initial trial tribunal.
