A defendant shall be punished by imprisonment for a year and a fine of KRW 300,000.

Punishment of the crime
Around January 26, 2014, the Defendant posted a false statement of advertising that he/she had access to the Internet's website at the scarcity 9-dong, Gwanak-gu, Seoul Special Metropolitan City (Seoul Special Metropolitan City) to sell the observer 2's cell phone, thereby selling the observer 2's cell phone to the victim who reported and contacted the above advertising text, and then falsely reported the 110,000 won mobile phone to the victim D.
However, even if the defendant receives the mobile phone price from the victim, he did not have the intention or ability to deliver the above mobile phone.
The Defendant received KRW 110,00 from the victim to the bank account (E) in the name of the Defendant as the mobile phone sales proceeds, and received KRW 6,328,00,00 in total from the victims by the aforementioned method, over 65 times from January 7, 2014 to May 28, 2014, as well as from January 1, 2014 to May 28, 2014.
Accordingly, the defendant was provided property by deceiving the victims.
The Defendant, around December 5, 2012, 201, posted a notice on the Defendant’s home located in Kimcheon-si, stating that he will sell a mobile phone device by accessing the Internet NAVER car page to a computer, and then sent a false statement to the Victim G who reported the above writing as “to deliver the mobile phone device at home on the face of remittance of the price,” and then received KRW 80,000 from the victim to the agricultural bank account in the name of the Defendant at around 21:37 of the same day under the name of the victim as the sales proceeds of the Telecommunications phone, and received KRW 80,000 from that time from February 21, 2013 to December 0, 2013, KRW 1,43,000 as the aggregate sales proceeds of the mobile phone from the victims at 11 times in total, as shown in attached Table 2 of the Crime List 2.
