A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, Violation of the Road Traffic Act, and Violation of the Road Traffic Act, are those engaged in driving of B rocketing cars;
On December 25, 2014, the Defendant driven the said car while under the influence of alcohol of 0.107% of blood alcohol concentration around 03:40 on December 25, 2014, and led the Defendant to drive a approximately 4 km section from the roads near Yangcheon-gu Seoul, Yangcheon-gu, Seoul to the two-lanes of the entrance of the error or items in the south-gu Seoul Southern Circulation.
At the time of the defendant's front line, the victim C (the 47-year old) was driving a Drocketing taxi, which is set up at the center of plastic separation, and at the same time, the victim E (the 51-year old) is driving on the second lane of the opposite part, and therefore, there was a duty of care to maintain the safety distance and safely drive the vehicle.
Nevertheless, the Defendant neglected this and operated at a higher level and due to the negligence of changing the vehicle line, the part of the victim’s vehicle in front of the taxi in the Defendant’s vehicle driving was moved into the part of the driver’s vehicle in front of the Defendant’s vehicle, and the part of the victim’s vehicle in front of the taxi in the victim E driving was invaded by the center line.
Ultimately, the Defendant, by such occupational negligence, suffered injury to the victim C, such as salt ties and tensions that require approximately three weeks of medical treatment, and at the same time, damaged the said Drocketing taxi to be repaired by KRW 1,353,128, and damaged the victim E to undergo approximately two-day medical treatment, and suffered injury to the victim G (24 years of age) who was on the part of the victim E to undergo approximately two-day medical treatment, such as throst salt ties, tensions, etc., and at the same time, damaged the said F rocketing taxi to be repaired by KRW 5,06,131.
