Defendant A Co., Ltd. shall pay to the Plaintiff, KRW 1,489,700,07, and KRW 1,001,252,150 among them, as regards May 31, 2013.

1. Basic facts

A. 1) The Plaintiff (hereinafter “Defendant A”) entered into a limited trading agreement

B) On April 29, 2010, Defendant A received various guarantees and loans from the Plaintiff within the scope of KRW 6,536,928,000 (hereinafter “the First Limit Trading Agreement”).

B) On July 26, 2010, Defendant A received various guarantees and loans from the Plaintiff within the scope of KRW 7,681,248,000 (hereinafter “the Second Limit Trade Agreement”) and, in total, “each Limit Trade Agreement”.

(2) At the time, Defendant B and C, a joint representative director of Defendant A, jointly and severally guaranteed the indemnity liability that Defendant A would bear to the Plaintiff in accordance with each limit transaction agreement of this case.

B. A. Defendant A entered into a contract for construction and received advance payments. Defendant A entered into a contract for construction and received advance payments on April 27, 2010 (hereinafter “Dong Construction”).

)을 체결함과 동시에, 공사대금 5,353,920,000원, 공사기간 2010. 4. 27.∽2011. 2. 5.로 정하여 그 중 1차분 공사에 관한 계약을 체결하였고, 거동건설로부터 그 선급금으로 2010. 5. 27. 500,000,000원, 2010. 6. 14. 570,784,000원 등 합계 1,070,784,000원을 지급받았다. 2) 또한, 피고 A은 2010. 6. 30. 거동건설과 사이에, F 조성사업 중 투기장 및 접안시설 4곳을 설치하는 내용의 토공사(이하 ‘G 토공사’라 한다)에 관하여 공사대금 14억 원, 공사기간 2010. 6. 30.∽2010. 10. 31.로 정하여 공사계약(이하 ‘G 토공사계약’이라 한다)을 체결하였고, 그 무렵 선급금으로 280,000,000원을 지급받았다.
