A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
1. A violation of the social welfare business due to occupational embezzlement or use for any other purpose;
A. On October 10, 2014, the Defendant has been working for the victim D, a social welfare facility operated by the social welfare foundation C from October 1, 2014 to May 1, 2017, as a social welfare worker, while engaging in the financial and accounting of the said facility.
around January 23, 2015, the Defendant embezzled subsidies of KRW 579,238,530, totaling KRW 579,238,530 from Gwangju Viewing F to January 1/4, 2015, including subsidies of KRW 45,591,40, from Gwangju Viewing F to February 24, 2017, and granted subsidies of KRW 579,238,530 to the Agricultural Cooperative Account in the name of D and arbitrarily consumed for the said D’s personal expenses from around January 30, 2015 to the new bank account in the name of the Defendant’s name until April 25, 2017.
B. According to the use of subsidies for purposes other than their original purpose, the Defendant in violation of the Social Welfare Business Act is granted subsidies from the foregoing D office to operate vocational rehabilitation facilities for disabled persons of welfare corporations (operating expenses), subsidies for disabled persons admitted to welfare facilities for disabled persons (Class 4), and subsidies for operating welfare facilities for disabled persons (Class 7). Therefore, such subsidies should be used according to their respective purpose.
Nevertheless, on January 29, 2016, the Defendant used subsidies of KRW 9,418,30 as retirement allowances for G around January 29, 2016 and used subsidies of KRW 48,591,050 in total over 42 times from around that time to April 25, 2017, such as the list of crimes (2) in attached Form 42.

A social welfare foundation that violates the Social Welfare Business Act following the use of social welfare foundation's profits for other than its original purpose shall establish a corporation or corporation's social welfare facility.
