1. The defendant shall be punished by imprisonment with prison labor for eight months;

2. The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

[criminal history] On June 30, 2011, the Defendant was sentenced to four years of imprisonment by the Gwangju High Court for a violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (obscenity using communications media), and completed the execution of the sentence in a military prison on October 4, 2014.

Accordingly, the defendant reached victims who cause sexual humiliation through telephone for the purpose of meeting sexual desire.

[2017 Highest 145] On October 28, 2016, the Defendant: (a) calls from the Defendant’s house located in the South west-gun C around 21:39 on October 28, 2016 to the Victim F (hereinafter referred to as the “FF”) by sending a cell phone to the Defendant’s house located in the South west-gun C; and (b) promptly calls from the victim F (a) to divide his/her number on a random basis by using a cellular phone; and (c) hereinafter “FFF, bit

Accordingly, the Defendant reached the victim with the intent to satisfy the sexual desire by telephone, which causes sexual humiliation.

Around October 26, 2016, the Defendant called “1, 2017 Highest 384, the Defendant,” saying, at the home of the Defendant located in C, in the South west-gun, 17:36 on October 26, 2016, the Defendant called, “1, 200, 200, 200, 384, 200, 200, 200, 200, 2000, 200, 2000, 200, 2000, 200, 200, 200, 200, 205).

Accordingly, the defendant has caused sexual humiliation to the victim by telephone for the purpose of meeting the sexual desire.
