A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
"2018 Highest 1087"
1. On April 11, 2018, the Defendant related to the Victim B: (a) 13:45 on May 11, 2018, in the “C’s operation” of the Victim B located in Ulsan-si, Ulsan-do, wearing gold and gold scrap; and (b) 18K gold scrap (market price equivalent to KRW 1,586,00) on the part of the injured party, owned by the injured party; and (c) 18K gold cover (market price equivalent to KRW 1,385,00) on the part of the injured party, and stolen them by means of escape.
2. On the same day as indicated in the above paragraph 1, around 17:09, the victim D related Defendant stolen 1 gold 18K mp, which is the victim’s ownership (on a market price of KRW 1,700,000), and 18K mpher (on a market price of KRW 1,700,000) by using the same method as described in the above paragraph 1.

1. On April 11, 2018, the Defendant: (a) around 13:45 on the same day from “H” operated by the victim G in Yangsan-si F; (b) around 14:0 on April 11, 2018, around 13:45 on the same day; (c) around 18K golding 1, which was stolen from “C” located in Ulsan-gun, Ulsan-gun; (d) as if the Defendant was the genuine owner, the Defendant was able to run as if the Defendant was the true owner; and (e) received KRW 7:50,0
2. According to the evidence duly adopted and examined by this court, at around 17:49 of the same day, at around 17:09 of the same day, the Defendant: (a) “one gold 18 K 18 K mpppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppppp, the victim, in the manner described in paragraph (1) of this part of the indictment, at around 17:09 on the same day; and (b) even if it was corrected without any amendment procedure, it does not affect the Defendant’s defense. Therefore, it shall be corrected ex officio as above.
The defendant was committed as if he was the true owner, and the victim G was placed as a security, and the victim was delivered KRW 1 million from the victim.
In this respect, the defendant has twice through two times.
