A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. No one, other than persons handling narcotics, etc. in violation of Acts on the Control of Narcotics, etc., shall administer, or assist in the sale and purchase of, local mental drugs;
Despite the fact that the Defendant is not a narcotics handler, the Defendant administered and arranged for the sale of mert clopty (one philopon; hereinafter referred to as “philopon”) which is a local mental medicine as follows.
A. On July 7, 2016, the Defendant: (a) received KRW 1,300,000 from C, a later-round 17:00,000, to request the purchase of phiphones; and (b) withdrawn the purchase of phiphones; and (c) requested D to purchase phiphones.
On the same day, the Defendant arranged for the purchase and sale of phiphones by arranging C to purchase 5 g of phiphones from D in the G rocketing car parked in the F parking lot located in Kimhae-si, 18:50 on the same day, by arranging C to purchase 5 g of phiphones.
B. (1) At around 19:00 on the same day as the above paragraph (a) above, the Defendant injected the Defendant’s car parked as above with the 19:00 square meters of the philophone, dilution of an amount equivalent to 0.05g of the philophones delivered by the said D, and then injected it on the Defendant’s arms.
(2) On July 17, 2016, at around 03:00, the Defendant administered an apartment of H 204 Dong 603, Kimhae-si in the above manner at the dwelling of the Defendant, and at least 0.05g of phiphones.
2. Violation of the Narcotics Control Act;
(a) No person shall smoke marijuana;
Nevertheless, at around 16:00 on July 23, 2016, the Defendant dumped one tobacco plant at an insular place (hereinafter referred to as Kimhae-si), and dumped one tobacco plant at this place, and dumped by inserting an insular volume among the hemps collected from Ysan-si.
(b) No person other than a handler of narcotics, etc. in possession of marijuana shall carry it;
