A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, as a person working in the “C Real Estate” located in Ansan-si, Ansan-si, and was willing to conclude a sales contract for E, F, and G land owned by D, without being delegated with the authority to conclude a sales contract, prepared a purchase and sale contract in the name of D’s agent and delivered it to the purchaser of the land to the victim H as if he had been granted the authority to conclude a sales contract for D’s land, and thought that he was used to pay the purchase and sale contract deposit from the damaged person
1. On March 26, 2015, the Defendant prepared a private document for qualification solicitation without authority for the purpose of uttering within the said C’s real estate on or around March 26, 2015, without authority, to pay in the column for the location of the real estate transaction contract for the following: “E, F, and Class 1 dwelling in Gyeonggi-do; “One-class dwelling in the land column separate”; “50% (50%) out of approximately 2452 in the size column; “52, approximately 742, KRW 50,00 in the purchase price column”; “The sale price column is KRW 30,000,000 (30,000,000 in the down payment column)”; and “The sale price is KRW 30,000,30,000 in the remainder column on the following day.”
In the loan column, “A” was written in the column for the seller’s address, “A” in the column for the seller’s address, “J” in the seller’s telephone column, “K” in the seller’s name column, “D” in the seller’s address column, and “A” in the name column for the agent address column.
As a result, the defendant, who is a land owner, prepared one copy of the real estate transaction contract, which is a private document on the rights and obligations in the name of D by gathering the qualification of agent of D, which is a land owner.
2. The Defendant, at the same time and place as the above Paragraph 1, presented to the victim who is unaware of the fact that one copy of the real estate transaction agreement drawn up with qualification as above was duly formed.
3. The Defendant’s fraud is at the same time and place as the above paragraph 1.
