Reasons
Punishment of the crime
1. Fraud against the victim B;
A. On December 17, 2019, the Defendant phoneed the victim B from the Buddhist land on December 17, 2019, and terminated three months after paying a charge to the victim B for opening a mobile phone in the name of four.

However, even if the defendant opens a mobile phone in the name of the victim, he/she did not have the intention or ability to terminate the fee normally or after three months.
In this regard, the Defendant: (a) by deceiving the victim as above; and (b) obtained the pecuniary benefits equivalent to the amount of KRW 1,146,750 of the mobile phone fee from the issuance of one unit of gallon (E) at the market price of KRW 2,398,00,000, which was opened to the victim’s name from the victim in Gwangju Northern-gu C on the same day; and (c) did not pay the mobile phone fee to the victim.
B. On February 12, 2020, the Defendant phoneed the victim at the scopic land and resolved the unpaid mobile phone amount that had been opened previously only one month.
In four names, the mobile phone will be sold in the main body of the mobile phone and paid with the friendship, and the payment of the short term shall be borne by the party, and the mobile phone will be terminated after one week.

However, even if the defendant received a cell phone from the injured party, he did not have the intention or ability to cancel the cell phone after one week.
In this regard, the Defendant: (a) by deceiving the victim as above; and (b) obtained the pecuniary benefit equivalent to the amount of KRW 2,070,780 of the mobile phone fee from G located in Gwangju Northern-gu to the victim’s name on the same day; and (c) did not pay KRW 1,375,000 of the market price opened in the name of the victim from G located in Gwangju Northern-gu.
2. Fraud against victim I;
A. On February 2020, the Defendant paid the victim I a mobile phone fee, etc. in the trade in French-dong-dong-dong, Gwangju, and then changed the name three months after the opening of the mobile phone in four names.
