A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

피고인은 C, D, E, F, G, H와 함께 상습으로, 2009. 11. 21.경 서울 강남구 I건물 805호에 있는 J의 집에서, 마치 정상적인 방법으로 도박을 할 것처럼 피해자 K에게 속칭 ‘훌라’ 도박을 하자고 속이고 이에 속은 피해자를 상대로 한판에 100만 원에서 500만 원까지의 판돈을 걸고 훌라 도박을 하던 중, 피고인 일행 중 한 사람이 미리부터 알고 있던 은어를 이용하여 자신이 도박에게 이기기 위하여 필요한 카드를 참가한 다른 공범에게 알려주고 이를 알아챈 다른 공범이 상호 필요한 카드를 내어주는 방법으로 도박을 진행하여 위 도박에서 패한 피해자 K으로부터 1,000만 원을 교부받은 것을 비롯하여 2006. 6. 2.경부터 2011. 3. 31.경까지 사이에 위와 같은 방법으로 별지2 범죄일람표 기재와 같이 피해자 J, L, M, N, O, P, Q, K, R, S, T, U, V, W, X, Y, Z, AA, AB, AC, AD, AE, AF 등 총 23명의 피해자들을 기망하여 이에 속은 피해자들로부터 같은 방법으로 195회에 걸쳐 합계 17억 50만 원을 교부받아 이를 편취하였다.
