Punishment of the crime

1. Defendant A is a person who operates animal feed and prepared food business under the trade name, which is, a fisheries company B, in Gosung-gun, Gosung-gun.

A business operator who operates discharging facilities and prevention facilities or a person who intends to operate such facilities shall operate the wastewater discharged from wastewater discharge facilities in sequence, such as a separation tank of flowing water, a water-supply system, a reaction tank, an inn, a bed tank, and an slope tank, etc., and shall emit the wastewater below the permissible emission levels by operating the normal emission and prevention facilities of water pollution.

Nevertheless, around January 1, 2014, the Defendant released wastewater without permission by connecting wastewater flowing into prevention facilities with a ice that directly flows into sewage mouth from a fisheries company B without going through the above prevention facilities.

From around that time to December 30, 2014, the Defendant discharged chemical oxygen demand (COD) 1,213mg/L (standard 50mg/L), biochemical oxygen demand (BOD), 6,840mg/L (standard 40mg/L), suspended solids (S), 580mg/L (standard 40mg/L), total nitrogen (T-N), 912mg/L (standard 30mg/L), total nitrogen (T-N), 89.80m/L (standard 4mg/L) (T-P) total quantity (T-P) 89.80m/L (standard 4mg/L) on a daily basis.

2. The Defendant Company B was engaged in animal feed and pharmaceutical food business, and at the same time and place as that of paragraph (1), A, the actual operator of the Defendant, committed the same violation as that of paragraph (1) in relation to the Defendant’s business.
