The prosecution of this case is dismissed.

1. The Defendant is a person charged with repairing his bicycle in the “D” operated by the victim C (Nam, 49 years old) in Busan-gu, Busan-do.

At around 16:40 on August 23, 2019, the Defendant: (a) was unable to repair the parts previously repaired by the victim; (b) but the victim was waiting to repair the bicycles of another customer; and (c) was waiting to repair the bicycles of the other customer; and (d) was in conflict with each other on the ground that the victim was unable to memory the facts that he had been previously repaired, the Defendant saw the victim’s face two times with his hand, booms the victim’s chest with his arms and hand, and her head two times with his face.

Accordingly, the defendant assaulted the victim.

2. Determination

(a) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act;

B. After the prosecution of this case, the victim expressed his intention that he does not want the punishment of the defendant.

(c) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
