A defendant shall be punished by imprisonment for not less than five months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

”, “ 이 씹새끼야”, “ 쓰레기 같은 새끼야” 라는 등의 욕설을 하며 경위 E의 가슴 부위를 손과 주먹으로 약 10회 가량 치고, 밀치는 등 폭행하고, 이에 경위 E, F이 피고인을 현행 범인으로 체포하여 순찰차에 태운 다음 같은 날 15:33 경 부산 동구 G에 있는 부산 동부 경찰서 D 지구대 앞 주차장에 도착하여 순찰차 차량 문을 열어 내리게 하자, 순찰차에서 내리면서 갑자기 경위 E의 가슴 부위를 주먹으로 1회 때려 폭행하고, 계속해서 D 지구대 안에서도 상황근무를 하고 있는 경위 H 등 경찰관들에게 “ 이 새끼야”, “ 미친 새끼들 아”, “ 내가 이 동네 누 군지 아나” 라는 등 욕설을 하면서 지구대 바닥에 주저앉아 뒹구는 등 소란을 피우고, 이를 제지하는 경위 H의 발목 부분을 수차례 발로 걷어 차 폭행하였다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the suppression and investigation of two police officers.
