1. Defendant B’s KRW 48,158,180 for the Plaintiff and 12% per annum from March 13, 2013 to April 10, 2014.
Reasons
1. Determination as to the plaintiff's claim against the defendant B
A. (1) On March 19, 2009, the Plaintiff loaned KRW 50 million to Defendant B with interest rate of KRW 12% per annum and due date of repayment on December 31, 2009. On August 20, 2011, Defendant B agreed to pay KRW 58 million per annum on October 31, 201, and interest rate of KRW 12% as of the above principal and interest rate of KRW 58 million between the Plaintiff and Defendant B does not conflict.
(2) According to the above facts of recognition, Defendant B is obligated to pay the Plaintiff KRW 58 million and its delay damages, unless there are other special circumstances.
B. Determination as to Defendant B’s assertion (1) is based on Defendant B’s claim for fishery products price claim of KRW 20,985,000, which was supplied from February 7, 2012 to September 5, 2012 by the Plaintiff as indicated in the following table, and is set off against the Plaintiff’s loan claim against Defendant B, the remainder of which was partially repaid as interest.
