Facts of recognition

Around August 2, 2009, the Defendant, as the president of the Non-Party Incorporated Association C (hereinafter “C”), as the non-corporate group, drafted a lease agreement with Nonparty D Co., Ltd. (hereinafter “D”) on the F building G or H units of the F building E located in Yong-Gun, Chungcheongnam-gu, Gun, in the separate sheet (hereinafter “instant real estate”), including each real estate (hereinafter “D”), as the head of the non-corporate group, around August 2, 2009, with the lease term of KRW 200 million from August 12, 2009 to August 11, 2012.

(A) Accordingly, C occupied and used the instant real estate and F building H from around that time after being handed over by D.

The Defendant registered the establishment of chonsegwon in the name of the Defendant on January 17, 201, completed the registration of the establishment of chonsegwon (hereinafter “instant chonsegwon”) with respect to the instant real estate owned D as of August 12, 2009, with the term of 200,000,000 won for lease on a deposit basis as of August 12, 2009, and from August 12, 2009 to August 11, 2012.

On August 12, 2012, I prepared the lease deposit amount of KRW 130 million from August 12, 2012 to August 11, 2014 with respect to the instant real estate as the president of C at the time of August 12, 2012.

(A) On the other hand, on the same day, I prepared a lease deposit amount of KRW 70,00,000 between J and the owner of F Building H on the same day.

On August 12, 2016, K entered into a lease agreement with D as of August 12, 2016, with respect to the instant real estate between D and D as of August 12, 2016, with a lease term of KRW 130 million from August 11, 2016 to August 11, 2018.

(A) On February 14, 2018, the Plaintiff’s application for acquisition of the right to collateral security and voluntary auction is a company established for the purpose of sales and purchase of non-performing loans, and on February 14, 2018, the principal and interest of the loan equivalent to KRW 50 million,000,000,000, which Nonparty
