Reasons
Punishment of the crime
Any person who intends to engage in credit business or loan brokerage business (hereinafter referred to as "credit business, etc.") shall register his/her business with the Special Metropolitan City Mayor, Metropolitan City Mayors, Do Governors or the Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor"), having jurisdiction over the relevant business office, and no credit service provider may use violence, intimidation, arrest or detention, or deceptive scheme or force, in collecting claims under the loan agreement, if it loans to an individual or a small-scale corporation prescribed by Presidential Decree, exceeding the interest rate prescribed by Presidential Decree within the extent of 39% per annum (44% per annum and 30% per annum before June 26, 2011).

On October 6, 201, the Defendant violated the Act on the Registration of Credit Business, etc. and the Protection of Use of Credit Loans: (a) lent 34,50,000 won to the victim B who needs to be supplied with the loan; (b) borrowed 34,50,000 won to the foreign exchange bank passbook of the victim for 30 days; and (c) received 40,500,000 won with interest rate of 194% exceeding 30% from the interest rate of 194% from October 14, 2011 to January 7, 2013; and (d) borrowed 646,50,000 won to the necessary interest rate of 21 times, and received a large amount of interest and principal from 80,000 won to 80,000 won with interest rate of 194% from 80,000 won.
