The judgment of the court below is reversed.

1. Summary of grounds for appeal;

A. In regard to misunderstanding of facts: ① fraud listed in [Attachment 3] No. 3 of the List of Crimes (hereinafter referred to as “crimes of fraud”; ② the Defendant works as a fertilizer manager from around April 2006 at agricultural cooperative D branch (hereinafter referred to as “D branch”) to take charge of the fertilizer work from around May 15, 2008; and his successor took charge of the fertilizer work.
