A defendant shall be punished by imprisonment for three years.

The defendant shall be ordered to complete a sexual assault treatment program for 40 hours.

Punishment of the crime

The defendant had access to the victim C (n, 18 years of age) and the victim's first-hand D before the singing room in Daegu Jung-gu.

On July 1, 2018, the Defendant, along with the Defendant’s daily happiness E, the victim, and the victim’s daily activity D, performed drinking at “G” located in the Daegu Jung-gu, Daegu-gu, and did not inform the victim of the destination on board the above E, and went ahead of the Defendant’s house located in H in the Daegu-gu, Seogu, Daegu-gu, without informing the victim of the destination.

피고인은 같은 날 07:00경 피고인의 집 안으로 들어가지 않으려는 피해자의 목을 팔로 감고 성관계를 안 하겠다는 취지의 말을 하며 위 원룸 I호에 있는 피고인의 집 안으로 들어간 후 피해자의 옆에 눕는 등 스킨십을 시도하였으나 피해자가 거부하자 갑자기 “너 진짜 짜증난다”라고 하면서 피해자의 어깨를 꽉 잡아 바닥으로 내리꽂고, 목을 조른 뒤 피해자의 입을 틀어막고 머리채를 잡아 머리를 바닥에 찧는 등 폭행하여 피해자가 울면서 소리를 지르자 "5초 줄테니 조용히 해라"라고 하면서 숫자를 세며 피해자에게 겁을 주었다.

계속하여 피고인은 위와 같은 폭행으로 반항이 억압된 피해자의 가슴과 엉덩이를 만지고, 스타킹과 팬티를 벗기려고 하여 피해자가 발버둥을 치며 거부하고, "제발 한 번만 보내달라. 집에 엄마가 기다린다. 언니도 기다린다"라고 함에도 “너 입으로 할래 할래 그 두 개 중에 니가 결정해라. 5초 준다”라고 하면서 피해자의 어깨를 잡고 매트리스 위로 내리꽂고, 피해자의 머리채를 잡고 바닥에 수 회 머리를 내리찧고 피해자의 가슴을 만지고 옷을 벗기려고 하면서 구강성교를 강요하였다.
