Pursuant to Articles 43-2 and 43-3 of the Public Property and Commodity Management Act (hereinafter “Public Property Act”), Defendant Korea Asset Management Corporation was entrusted by the head of Seoul Metropolitan City, the head of the Nam-gu Seoul Metropolitan Government with the management and development affairs concerning reinforced concrete building slabs underground, 6 stories above ground, 9 stories above ground, and 50,132.64 square meters in total area under the Public Property Act (hereinafter “instant real estate”).
On April 28, 2017, Defendant Korea Asset Management Corporation entered into a lease agreement with E Co., Ltd. (hereinafter “E”) with regard to “8,476.57 square meters of exclusive use area, “8,928.90 square meters of public use area,” “17,405.47 square meters of contract area,” among the instant real estate (hereinafter “instant lease agreement”) with the term “lease deposit 1,400,000,000 won,” and “nine years from the date of commencement of the business of lease” on June 15, 2017.
According to the instant lease agreement, E installs an escalator at its own expense from the first to the fourth above ground level, and intends to contribute it to the Nam-gu Seoul Metropolitan City office, Seoul Metropolitan City, and the maintenance and management of it will be in charge of the Defendant Asset Management Corporation.
E on June 20, 2017, Defendant B Co., Ltd. (hereinafter “Defendant B”) entered into a contract with Defendant B (hereinafter “Defendant B”) on June 16, 2017 by setting the construction period from June 16, 2017 to September 28, 2017 for the large-scale repair works for the installation of escalators from the first floor to the fourth floor above the ground. The contract was finally concluded on August 7, 2017 by changing the contract amount to KRW 1,60,000,000, and the contract amount to KRW 1,38,682,000 on February 7, 2018.
Defendant B, on June 21, 2017, with respect to the construction cost of KRW 360,000,000 and the construction cost of the construction work of KRW 360,000,00, and the construction period from June 17, 2017 to September 20, 2017.
