1. The Defendant’s KRW 35 million and the following day from August 1, 2017 to June 30, 2019 to the Plaintiff.

In light of the absence of dispute between the parties concerned or the overall purport of the evidence and the argument, the Defendant borrowed KRW 40 million from the Plaintiff on July 28, 2016 as of July 31, 2017, and thereafter, the Defendant may recognize the repayment of KRW 5 million out of the borrowed money to the Plaintiff.

Therefore, the Defendant is obligated to pay to the Plaintiff the remainder of KRW 35 million and the damages for delay calculated at the rate of 5% per annum as stipulated in the Civil Act from August 1, 2017, the day immediately following the due date to June 30, 2019, and 12% per annum as stipulated in the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from the next day to the day of full payment.
