A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
[criminal records] On February 17, 2016, the Defendant was sentenced to imprisonment with labor for one year and a fine of 300,000 won for fraud, etc. at the Daegu District Court, and the judgment became final and conclusive on February 25, 2016.
[2] The Defendant: (a) opened a cell phone (number : J) in the name of the victim B who was in a pet relationship with B; and (b) held a driver’s license issued by B in the name of B; and (c) received a credit card in the name of B without the consent of B.
1. On March 3, 2015, the Defendant: (a) accessed the “Modern Card immediately issued service” on the Internet by using a computer located in the G mobile phone agency located in Jung-gu, Daegu, Daegu, which is operated by the branch; (b) connected the Internet homepage using a computer located in the branch; and (c) entered “B”, “E”, and “C” in the name column of the application for the immediate issuance of the modern card in the name of the resident registration number column; and (d) submitted an immediate application for issuance of a modern card, which is an electronic document in the name of B related to rights and obligations, to an employee of the said company, who is not aware of the fact, as seen above, on the said website, as if the application for the immediate issuance of the said modern card was duly prepared.
2. Fraud;
A. On March 6, 2015, at the office located in Jung-gu, Daegu, as described in paragraph 1, the Defendant: (a) drafted an application for access to the victim’s (State) Hyundai Card website; (b) immediately issuing the said application on the victim’s name; and (c) submitted the victim’s non-employee with the immediate application for issuance of the said modern card; and (d) by deceiving the victim; and (e) by deceiving the victim, the Defendant acquired one copy of the current card (N) at the market price issued by the victim.
B. On June 20, 2015, the Defendant related to the re-issuance of a credit card is as mentioned in the foregoing A.
