1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. In the land investigation book prepared in the Japanese colonial era, G is written as to FJ D (the name of the administrative district was changed to hereinafter referred to as “Maju-si”), 291 square meters (hereinafter referred to as “F land before division”) in Gwangju-gun, and K is written as to H forest land 90 square meters (8,926 square meters), I forest land 45 square meters (hereinafter referred to as “I forest”) (4,463 square meters; hereinafter referred to as “I forest”), J forest 14 square meters (1,38 square meters, and land indicated in paragraph (4) of the indication of annexed real estate).
B. On March 8, 1957, the registration of ownership preservation was completed with respect to the F land before the partition. Of the above land, 462 square meters was divided into M on April 16, 197, and the remainder of 500 square meters (hereinafter “F land”) was completed on May 25, 1988 with respect to the land indicated in paragraph (1) indicating attached real estate; hereinafter “F land”).
C. On March 28, 1979, the registration of ownership transfer of P’s name was completed pursuant to the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (hereinafter “Special Measures Act”), and the registration of ownership transfer was completed on August 27, 1986, following the transfer of ownership in the name of Defendant Korea Culture Promotion Co., Ltd.
Among the above forest land, 62m2 was divided into Q on November 7, 1988, and the remaining part of 150m2 is the forest land indicated in attached Form 2.
In accordance with the Act on Special Measures (Act No. 3562) on March 7, 1985, the preservation of ownership in the name of R was completed with respect to the I forest, and the transfer of ownership in the name of the defendant Arts Council Korea was completed on September 26, 1987.
After all, the forest land was combined with the forest land in Gwangju city and the forest land in Gwangju city, thereby becoming 53,409 square meters in Gwangju city.
E. On June 28, 1984, as to the forest land indicated in paragraph (4) of the indication of the attached real estate (hereinafter “J forest”).
