피고인은 2012. 4. 16. 15:20경 서울 강남구 E 어학원 5층 화장실에서, 소변을 보고 있는 피해자 F(남, 6세)를 보고 갑자기 피해자의 어깨를 손으로 밀어 좌변기 화장실 안으로 데리고 들어가 출입문을 잠그고 출입문 앞에 버티고 서서 피해자가 도주하거나 반항하지 못하게 한 후, 무릎을 꿇은 채 코로 피해자의 성기부위의 냄새를 맡다가 피해자의 성기를 혀로 핥고, 피고인의 바지와 팬티를 내린 다음 피해자의 손으로 피고인의 성기를 흔들게 하였으나 피해자가 제대로 흔들지 못하자, 피해자에게 계속 피고인의 성기를 만지게 하면서 스스로 성기를 흔들어 자위행위를 하는 등의 방법으로 피해자를 강제로 추행하였다.
