1. The Defendant’s KRW 139,551,481 as well as 5% per annum from May 1, 2015 to June 22, 2016 to the Plaintiff.
Reasons
1. Occurrence of liability for damages;
A. The Plaintiff, from March 2013 to March 3, 2013, has obtained a license for the fish farming business from the former Yan-gun C, the Plaintiff installed two dubs (170 cans, 160 cans, hereinafter referred to as the “instant aquaculture”).
A) The Defendant operates a fishing vessel D (hereinafter referred to as “instant vessel”) which is owned by the Defendant.
(2) Around March 2013 and April 2013, the Plaintiff, along with her husband E, distributed approximately KRW 200,000 of the previous uniforms to the 160 canas set up in the instant model. From March 15, 2015 to March 17, 2015, the average of approximately 1,100 can be applied to the previous uniforms depending on the size of the uniform.
3) On April 30, 2015, the Defendant: (a) went through around 21:00 on May 1, 2015, when the instant vessel was in operation after leaving the port to be the instant vessel; and (b) made the instant vessel collision with the instant aquaculture; and (c) as a result, the instant vessel’s instant vessel was in operation at the port to be the port to be the instant vessel; and (d) the instant vessel was in operation at the port to be the port to be the owner of the instant vessel (hereinafter “instant accident”).
(4) As a result of the instant accident and the investigation into the site of the instant accident upon receipt of a report on May 2, 2015, immediately after the instant accident, it was confirmed that the instant accident and the instant vessel were destroyed by 12 canalone out of 160 canalone and that a large number of entire parts in the form were lost. 5) The Defendant stated at the police that “the instant accident occurred due to the malfunction while operating the instant vessel, because it was impossible to find the form of the instant vessel,” and the Plaintiff stated at the police that “from the 12 canalone to the 12 canalone destroyed by the instant accident, approximately 8,260 canal one out of the 12 canalone which was destroyed by the instant accident.”
