1. The Defendant’s KRW 495,797,433 among the Plaintiff and KRW 101,00,000 among the Plaintiff, shall be KRW 394,797,433.

1. Basic facts

A. The plaintiff is the party 1) The plaintiff is the 356-dong 356 apartment units in Seongbuk-gu, Seongbuk-gu, Sungnam-gu (hereinafter "the apartment unit of this case").

(2) A B apartment reconstruction and rearrangement project association (hereinafter “B apartment reconstruction and rearrangement project association”) is a project implementer who constructed and sold the apartment of this case, and C Co., Ltd. (hereinafter “C”) is a company that entered into a contract for construction work of the apartment of this case with the non-party association and constructed the apartment of this case.

3) The name of the Defendant [the Korea Housing and Urban Guarantee Corporation (Law No. 12989)] was changed from July 1, 2015 to the Korea Housing and Urban Guarantee Corporation pursuant to Articles 1 and 4 of the Addenda to the Housing and Urban Fund Act (Act No. 12989).

[2] On January 5, 2012, the Defendant entered into a contract for defect repair (hereinafter “instant contract for defect repair”) with C and Sungnam market as a guarantee creditor after a pre-use inspection on the instant apartment as to the instant apartment (hereinafter “instant contract for defect repair”) with the content that guarantees C’s obligation to repair defects after the pre-use inspection on the instant apartment.

The main contents of the instant guarantee agreement are as follows.
