In order to reverse the part on the medication of each local mental medicine in the O hotel.
Defendant .
Reasons
1. The summary of the grounds for appeal by the prosecutor is as follows: (a) according to the prosecutor's office, L, P and U's respective prosecutor's office and the court below's statement, each of the facts charged in this case has been clearly proved; (b) however, the court below erred by misapprehending the facts and affecting the conclusion of the judgment.
2. As to the sales of each part of the judgment below's judgment
A. The summary of the facts charged (1) of this part of the charges is as follows: (a) each of the following three times (2014 highest 3136, (2014 highest 3136; (c) the Defendant sold 1-A, 300,000 won in front of a bank near Gangnam-gu, Seoul; (a) received KRW 500,000 and sold 0.5 g of a philopon, which is a part of a plastic medicine in vinyl, to C, and (b) received KRW 50,000 in front of G store in Gangnam-gu Seoul, Seoul; and (c) sold KRW 1-g of a philopon contained in a plastic bag to C from around 12, 2012 to around 50,000, which was supplied to C with an 1-gopon that contained in the plastic bag; and (c) sold the 1-gopon to C from around 121, 2012.
(B) The Defendant sold “EM” (Article 2(2) of the charges No. 2015 order 107) to MM (hereinafter “EX”) one time (Article 2(2) of the charges). Around November to December of 2011, the Defendant received KRW 300,000 from C in front of the Seoul Seongdong-gu Apartment apartment shop, Seongdong-gu, Seoul, and sold the EXP, a local mental medicine.
(2) The Defendant: (a) sold each penphone (2014 high group 3136 high group 1-D, f (2014 high group 3136); (b) around July 2013, the Defendant: (a) delivered approximately KRW 80,000 and sold 1g of a penphone to L on the front side of L in Gangnam-gu Seoul; (b) around August 2013, the Defendant issued approximately KRW 80,000 and KRW 1g of a cellphone on the front side of L on a plastic bag, which is contained in the plastic part of L with KRW 80,000 and received KRW 80,00 to L.
