Punishment of the crime

Defendant

A is the chairman of the council of occupants' representatives of the Seo-gu, Seo-gu, Seo-gu, Seo-gu, Incheon, and the defendant B is the head of the above apartment management office, who manages personal information for the purpose of managing CCTV installed in the above apartment.

1. On September 2014, Defendant A requested B to the effect that “it is necessary to submit evidence to the court in connection with the lawsuit filed against the council of occupants’ representatives regarding the lawsuit.” Accordingly, around September 10, 2014, Defendant A provided two copies of the photograph printed out in CCTV from B at the above apartment management office on July 23, 2014 and on the same day:40:16 and 13:40:49 on the same day.

On September 20, 2014, the Defendant received four copies of the photograph printed in CCTV from B at the same place from September 17, 2014 to September 20:08:59 on the same day.

As a result, the Defendant received E personal information with knowledge of the circumstance that B, a personal information manager, provided E with personal information beyond the scope prescribed by the Personal Information Protection Act without the consent of E.

2. Defendant B received the same request as described in the foregoing paragraph (1) from A on September 2014, and around September 10, 2014, at the above apartment management office around July 23, 2014, Defendant B printed two photographs of the part of CCTV taken by E on CCTV and provided it to A.

In other words, the Defendant, at the same place around September 20, 2014, printed four copies of photographs of the part in which he/she was exposed to CCTV from September 17, 2014 to September 20:08:59 on the same day and provided them to A.

As a result, the defendant provided the personal information to a third party beyond the scope set forth in the Personal Information Protection Act without the consent of E, which is the subject of information.
